Considerable research evidence has accumulated indicating that there is an increased likelihood for illness and injury among employees working in long-hour schedules and schedules involving unconventional shift work. In addition, studies show that fatigue-related errors made by employees working in these kind of demanding schedules can have serious and adverse repercussions for public safety. As the result of these concerns, new protective legislation is being advocated in the United States, for instance, to restrict the hours of work among nurses and (...) other healthcare professionals. This article reviews the history of concerns about long working hours and the current scientific evidence regarding their effects on workers' health. The ethical implications of unconventional shift work and long work-hour schedules are considered. Relevant ethical considerations involve mandatory or unpaid overtime and the possibility of employer coercion, the political basis for government regulation of working hours, potential limits on voluntary assumption of risk, societal benefits accruing from the equitable distribution of available working hours, gender-based inequities related to working hours, and employer responsibilities for protecting individuals who are not employees from the spillover effects of demanding work schedules. Allard-Nelson It has been argued that Aristotle's description of excellence (aretê) as a capacity (dynamis) in Rhetoric 1.9 is inconsistent with his treatment of excellence in Nicomachean Ethics 2.5, where he specifically argues that aretê is not a dynamis, but a hexis (i.e., a state or condition). (...) 1 Certainly, the word that Aristotle uses throughout the Nicomachean Ethics to both describe and categorize aretê is hexis, and he uses this word at Rhetoric 1.6.1362b13, where he says that several of the virtues, and all other such states (kai hai allai hai toiautai hexeis), are excellences of the soul. However, as part of his discussion of the ethical aspects of oratory, Aristotle states that aretê is "a capacity (dynamis) of providing and preserving good things, and a capacity of conferring many great benefits (euergetikê)" (Rh. 1.9.1366a36-1366b1). 2 This discussion is set in language similar to that used to discuss excellence and goodness in Rhetoric 1362b2-4 and 1361a28-30; this suggests that Aristotle intentionally identifies aretê with dynamis in this text, and, to some degree at least, with the dynamis to benefit others. In the former passage, Aristotle claims that "the excellences, too, must be a good thing, for those who possess them are in a good condition, and they are productive of good things and good actions" (Rh. 1.6.1362b2-4). In the latter passage, Aristotle states that honor (timê) can be paid, not only to those who have already done good, but also to those who have the capacity to do good (dynamenos euergetein) in the future. Indeed, in the Rhetoric 1.9.1366b3-7, Aristotle further unites the concepts of excellence, capacity, and beneficence by stating, "If excellence is the capacity of conferring benefits (dynamis euergetikê), then the greatest virtues must be those which are the most useful to others, and, for this reason, justice and courage are the most honored; for the latter is useful to others in war, and the former both in war and in peace" (1366b3-7). In the absence of the Arabic text of al-Khw's Arithmetic, which has not yet been found, the oldest Latin adaptations from the twelfth century are the only evidence documenting the genesis and the first spreading of a decimal arithmetic that uses nine figures and zero, i.e. the Indian reckoning known in the Middle Ages as algorismus. This paper studies these texts, their content, their sources, and identifies their authors and the milieus in which they were written.

The term "false memories" has been used to refer to suggestibility experiments in which whole events are apparently confabulated and in media accounts of contested memories of childhood abuse. Since 1992 psychologists have increasingly used the term "false memory" when discussing memory errors for details, such as specific words within word lists. Use of the term to refer to errors in details is a shift in language away from other terms used historically (e.g., "memory intrusions"). We empirically examine this shift (...) in language and discuss implications of the new use of the term "false memories." Use of the term presents serious ethical challenges to the data-interpretation process by encouraging over-generalization and misapplication of research findings on word memory to social issues. Harry Allard's very engaging and popular picture book Miss Nelson Is Missing! raises an important ethical issue. The issue is whether it is morally permissible to adopt an immoral means if doing so promotes a morally good end. The book shows us how successful deceptive behavior can be and also provides with an opportunity for reflecting on why such behavior is morally wrong. So there is a lesson to be learned about the importance of approaching children's picture books armed (...) with philosophy. If a parent just reads Miss Nelson Is Missing! to a child without raising the issue of whether what Miss Nelson did was moral, the child might come away thinking that her parent approved of Miss Nelson's actions. And, if the child took this to heart, she might think that it was all right to deceive others so long as one did so for their own benefit. (shrink)

Hope beyond certainty is a significant element in contemporary theological discourse after the death of God. This relation between hope and uncertainty is not new. In the nineteenth century, a growing number of intellectuals started to call themselves agnostic, but did not always end up in scepticism and nihilism. On the contrary, new ways to search for meaning and fulfilment in life beyond the traditional answers of institutional religions (i.e. the church) were explored. The Dutch intellectual Allard Pierson (1831–1896) (...) is a good case in point. From a contemporary postsecular perspective and radical theology, this article argues that Pierson’s agnosticism should not be seen as an attitude of indifference, but as opening up the possibility for an eschatological hope beyond certainty. First, the (im)possibility of hope is discussed by debating the views of David Newheiser, Richard Kearney, and John D. Caputo. Second, the article analyses Pierson’s view by focusing upon hermeneutics instead of epistemology, an openness to transcendence, and imagination. The article thereby contributes to the understanding of nineteenth-century religious and secularisation developments as well as to contemporary theological debates on the (im)possibility of faith and hope after the death of God. Paper, $29.95Until the appearance of Mander's book there had been no short general introduction to Bradley in print since Penguin dropped Wollheim's F. H. Bradley from their list. But in any case, as a result of the work of scholars since its last revision in 1969, Wollheim's account, despite its many virtues, is now known to be misleading in crucial places, for he remained to some extent in the grip of the dismissive caricature of Bradley bequeathed to analytic philosophers by Russell and Moore and stilloften just taken for granted. (See, e.g., almost any textbook which has a chapter on truth.) By drawing on this scholarship Mander offers us a philosopher strikingly different from this caricature. Mander's replacement portrayal is, in its broad outlines, accurate enough to be confidently recommended as giving a good general sketch of Bradley's views (excepting the ethics, which Woliheim managed to include), presenting them sympathetically but not completely uncritically in a way which should offer something of interest to both advanced undergraduates and their teachers. As Oxford has also recently published a selection from Bradley's works (Writings on Logic and Metaphysics, edited by James Allard and Guy Stock, with both general and topic-specific introductions), there is the added benefit that one who wishes to read him can now do so without being faced with wading through some intimidatingly large volumes of often meandering discussion in baffling prose. The two should make a good pair around which to structure classes concerning Bradley. I am not quite so confident about some of the detail of Mander's account, which is, moreover, sometimes explained in a way nearly as obscure as the original on which it is intended to cast light. This last is, of course, hard to avoid in expounding a writer whose whole cast of mind is opposed to the exact formulation of precise theses illustrated with clear examples, and is less misleading than artificial precisification; it also perhaps reduces the risk that students will use it as a substitute for, rather than a guide to, the primary texts themselves. And I want to stress that Mander's overall picture of Bradley's views seems to me reliable and as well situated historically as the book's ' G. M. C. He gives several reasons for selecting these two philosophers for attention: they are the most important of their time; they are misunderstood and misrepresented; and their views have much in common that is largely correct while being the main alternative solutions to the problems they confront. Further, ajoint treatment makes sense because "it is toJames, rather than Russell, let alone Moore, that we must look for a serious critique of Bradley" (417). This is a labor of love, exhibiting reading of remarkable breadth and depth and the familiarity with its subject matter that is the product only of decades of exploration. The robust design and conduct of pragmatic cluster randomised trials may be in tension with the ethical requirement to obtain written informed consent from prospective research participants. In our experience, researchers tend to focus on whether a waiver of consent is appropriate for their studies. However, pragmatic cluster randomised trials raise other important questions that have direct implications for determining when an alteration or waiver of consent is permissible. To assist those involved in the design, conduct and review of pragmatic (...) cluster randomised trials, we outline four critical questions to consider: (1) What is the nature of the intervention being evaluated? (2) Is the choice to use cluster randomisation justified? (3) Can the risk of recruitment bias be addressed? and (4) Is an alteration or waiver of consent appropriately justified? We recommend that researchers and research ethics committees conduct a stepwise analysis of a planned cluster randomised trial using these questions. To illustrate the application of this stepwise analysis, we use three pragmatic cluster randomised trials in the haemodialysis setting as case studies. (shrink)

We show that every infinite computable partial ordering has either an infinite Δ 0 2 chain or an infinite Π 0 2 antichain. Our main result is that this cannot be improved: We construct an infinite computable partial ordering that has neither an infinite Δ 0 2 chain nor an infinite Δ 0 2 antichain.

This paper assesses several prominent recent attacks on the view that epistemic justification is conceptually prior to knowledge. I argue that this view—call it the Received View (RV)—emerges from these attacks unscathed. I start with Timothy Williamson’s two strongest arguments for the claim that all evidence is knowledge (E>K), which impugns RV when combined with the claim that justification depends on evidence. One of Williamson’s arguments assumes a false epistemic closure principle; the other misses some alternative (to E>K) explanations of (...) a putative fact about the evidence a particular subject has. Next, I neutralize each of Jonathan Sutton’s three recent arguments to the conclusion that any justified belief constitutes knowledge. Finally, I consider a recent analysis of justification due to Alexander Bird, according to which justified belief is possible knowledge. I argue that Bird’s analysis delivers neither a sufficient nor (more importantly) a necessary condition for justification. [Word count: 149]. (shrink)

We investigate the way physical laws objectively refer to the entities they are about. Laws of mathematical physics do not refer directly to the “real world” but to an ideal specific domain of objects, which we term “scope”. In order to find out which real objects physical laws deal with, reference to the scope is not sufficient. We need in addition the search for domains to which laws apply — i. e. “empirical domains”— in order to establish their reference to (...) the “real world”. It is just in such empirical domains that we are able to discover the real entities physical laws objectively refer to. “Physical reality” turns out to be not something “given” but rather something “to come out” of the very process of scientific inquiry. A personal view is presented of how metaphysics and ontology stand at the beginning of the twenty-first century, in the light of developments during the twentieth. It is argued that realist metaphysics, with serious ontology at its heart, has a promising future, provided that its adherents devote some time and effort to countering the influences of both its critics and its false friends.

Institutional investors are increasingly becoming active owners through voting their shares and engaging in dialogue with investee companies to improve corporate environmental, social and corporate governance (ESG) performance. This article applies a model of stakeholder salience to the shareholder context, analysing the attributes of power, legitimacy and urgency, to determine the factors that are likely to enhance shareholder salience. It is found that a strong business case and the values of the managers of investee companies are likely to be the (...) most important contributors to shareholder salience. (shrink)

I have stressed here and elsewhere that perspective cannot and need not claim to represent the world "as we see it." The perceptual constancies which make us underrate the degree of objective diminutions with distance, it turns out, constitute only one of the factors refuting this claim. The selectivity of vision can now be seen to be another. There are many ways of "seeing the world," but obviously the claim would have to relate to the "snapshot vision" of the stationary (...) single eye. To ask, as it has so often been asked, whether this eye sees the world in the form of a hollow sphere or of a projection plane makes little sense, for it sees neither. The one point in focus can hardly be said to be either curved or flat, and the remainder of the field of vision is too indistinct to permit a decision. True, we can shift the point of focus at will, but in doing so we lose the previous perception, and all that remains is its memory. Can we, and do we, compare the exact extension of these changing percepts in scanning a row of columns extended at right angles from the central line of vision—to mention the most recalcitrant of the posers of perspectival theory?1 I very much doubt it. The question refers to the convenient choice of projection planes, not to the experience of vision.· 1. Clinical diagnostic medicine is an experimental science based on observation, hypothesis making, and testing. It is an use dynamic process that involves observation and summary, diagnostic conjectures, testing, review, observation and summary, new or revised conjectures, i.e. it is an iterative process. It can then be said that diagnostic hypotheses are also ‘observation-laden’. My aim is to enlarge on the strategies of medical diagnosis as these are meshed in training and clinical experience—that is, to describe the patterns of reasoning used (...) by experienced clinicians under different diagnostic circumstances and how these patterns of inquiry allow further insight into the evaluation and treatment of patients. I do not aim to present a theory and illustrate it with examples; I wish rather am to let a realistic example, similar to actual clinical scenarios, direct the exposition. To this end, I introduce an account of medical diagnosis—briefly comparing and contrasting it to other accounts—in order to focus on discussing the process of diagnosis through a detailed clinical case. Il «nuovo» pensiero non è più cronologicamente nuovo ad oltre ottant’anni dalla sua nascita e, tuttavia, forse oggi manifesta un carattere di novità e di urgenza maggiore di allora, come si suol dire una «rinascita» che giustifica l’interrogativo sul suo «futuro». La particolare situazione in cui ci troviamo a pensare e soprattutto a vivere, le nuove domande che le mutate condizioni storico-culturali pongono alla filosofia, possono trovare un modello di risposta se ci si volge indietro a quella particolare stagione della (...) filosofia tedesca che abbraccia i primi tre decenni del Novecento e che fu tragicamente strozzata e azzittita dal nazionalsocialismo. Non si tratta di affermare un ysteron-proteron, sarebbe troppo semplicistico, decisamente acritico e storicamente e filosoficamente inaccettabile. Accade però, nella storia, che dei fermenti non riescano a produrre frutti perché la temperie del tempo non lo permette oppure perché «inattuali», non pienamente adeguati al tempo, e rimangono quindi latenti finché non si verificano le condizioni ottimali per il loro sviluppo, divenendo in tal modo «adeguati » al tempo. È appunto quanto si è verificato con tutti gli autori che si ritrovano accomunati da un «dialogisches Prinzip», se vogliamo riprendere l’espressione di Martin Buber e che si è concretizzato nelle varie figure rappresentative e nei vari pensatori a cui lo stesso Rosenzweig farà riferimento nel suo breve excursus storico, come, neues Denken, Begegnungsphilosophie, Beziehungsphilosophie, Sprachdenken.
